Account locked by SMURF

Hi, my account is locked my SMURF cause I said him "idiot" and "stfu".
I asked him nice 3 times "Host wanna rmk ?" and he didnt answer. Then I wrote him "Idiot just say u wanna play rmk or not" and he banned me.

Is that reason to be banned after 6 month playing EuroBattleNet ?
I mean I can open new account for sure, but I want my old nick "kinderjaje".
